The Landlord Dilemma - lawsuit document.
The beginning of the mess happened when I started cleaning for my landlords in 2022. I worked as the cleaner for $300 per month cleaning both apartment buildings. Mine and the one across the street.
The problems that I was having was that homeless people were coming into the building doorways and sleeping in the doorways. They would make such a mess and leave garbage, along with other bodily fluids at times.
The landlords would come to my door every couple days to complain about the mess that the homeless people would leave behind. I tried to keep them out, but I couldnt watch the doorways all night long. And I would kick them out, but then they would come back later on and mess. So, I would have to clean up the mess they left behind and sometimes they would get in after I had kicked them out, but the landlord sometimes would come to check the apartment entrances and find the mess left by these homeless people. I would get yelled at and forced to go and clean up the mess right at that moment. When the deal was that I would clean when I had time. But that changed when I started cleaning. They would pay me a lot less than what was offered, and the cleaning was not on my time, but their own time. If I didnt clean up the mess in time, I was told that I would not get paid and that I would not being cleaning anymore if I cant keep up. Even though I would clean up and the homeless would come back hours later. I was forced numerous times to drop what I was doing and go with the landlord to see the mess that was left in the doorway to clean. They would get really angry when I would tell them that I was busy doing my own thing at the time, but they would not stop yelling and forcing to go with them and check the damages done. I had to drop a class I was teaching online a few times and go to see what had happened. I already knew that there was a mess to clean, but they would get really forcful and I had no choice.
The landlords would harass me constantly when I was cleaning for them. Every couple days, knocking and complaining, and this kept on for the entire time I was cleaning, until I could not do it anymore and I wouldnt clean anymore. Plus they would tell me I was not doing a good enough job and demand the keys to the buildings and that would be the last day I had to clean. But this would happen and then months later, I was asked again to clean. I took it because I thought it would be better this time. I cleaned and kicked people out like I was told to, but that did not stop the homeless, they still got in and they made problems, but the landlord did not fix the doorways until about the late summer in 2023. But it took 6 years for the landlord to fix the doors, but not the back doors. People still get into the buildings. I had watched someone pop open the door and get into the building a few times. I did not know this person but I had to kick them out a few times. They told me that they have been getting into that building for years. It was really easy to get in. Before I moved in they were coming in for years before me.
I was not traeted fairly when the landlord was acussing me of letting people through my window. I did not have my home phone anymore and if anyone needed to come by they had to come to my basement suit window. They have never came through the window. The livingroom window had a cat door, and my bedroom window had a rip from my cats, and I never let anyone crawl through. My son's window his screen went missing. I was not sure how that happened, or where the screen went. His window was always locked. And nobody ever had crawled through his window, but maybe for himself when he would sneak out with his buddies. But nobody ever came through the window for any reason. Its not fair to say that the landlord had watched someone go through the window when there never has been anyone EVER. The landlord has lied and stretched the truth on a wide scale.
The landlord was upset when I had asked for the payment that was owed for cleaning, and they both refused to pay me. I had gotten hurt that month and I didnt clean daily like I had before, it was every couple days and they didnt like that. They would complain again, over and over, and I did the cleaning, but it was really hard to cross over the construction that was going on outside the apartment buiding, and I had to crawl over the missing road and the construction to go and clean the building, but I did. Then the landlord would come by next day and complain that I did not clean, but I had been there early in the morning, cleaning. They would tell me that I was not there and I am lieing. I did the cleaning. I know I did. I know how hard it was to cross over the road to get to the other building to clean. But they refused and didn't pay me.
The landlords would complain between 15- 18 times a month. I know what I had to do, and the whole thing was because the doorways were very easy to get into. The doorways did not get fixed until the summer of 2023. By then, I was already harassed to the point that I did not enjoy living there and I did not want to clean anymore. The last 2 years from 2022 and 2023 were the worst. I was told I was not doing a good enough job and they would fire me and then hire me back every couple months. Then the landlords asked me and my son to do move outs and clean and paint the whole apartment and clean up cockroach droppings without the proper safety gear, and would only give us gloves, but nothing for our faces.
Putting our safety at risk, and then when I texted the landlord and told him that we were not feeling very well, he ignored the message. We only got $50 to clean that place and then paint it all. It took us three days to do that place. It was a one bedroom, but the infestation in there was huge.
The other place we had to clean, it was not to bad, but we had to clean it out, and paint that place too. We got only $50 for that job. It also took a couple days.
The other job I had done for the landlord, and this was an odd job, but I had taken my own time to tape and paint the stairwells in my building. I had to teach my English classes, but in my spare time I had painted the stairwells. The landlord didnt want to pay me for that job. I dont think he ever did. I also washed the whole basement area, the walls and all the way up to the second floor. I did not get paid for that job either. I was not paid the appropriate amount for cleaning in the first place. It was not agreed upon to pay me only $300 per month. It was offered to me when I was moving in. It was at $500- $600 or partial rent was taken off, but then suddenly I was only getting $300 and if I didnt like it, I was not going to get paid. The mininum wage here in Alberta $15.50 per hour. And for cleaners to clean apartment buildings is much higher than that. $25- $40 per hour in Alberta. Thats basic cleaning. I was cleaning every second day. Vacuuming and washing floors, carrying the vacuum up and down the stairs of the three story apartment buildings. Then to do the odd jobs, like taking out the garbage, and washing windows. Then, there is the mowing grass, and snow removal.
The landlord has made living at the address #104. 11136- 124St. Edmonton Alberta T5M 0J6. I was at this address for six years. It was the worst time ever. I would go out of my way to please these landlords and all I got in the end was acussations agianst me and forced for no reason from our home, and my one family pet is missing. I had searched for him. I have gone back a couple times calling and no luck. He is part of the family. It breaks my heart everyday that I cant find him. Its cold outside, its been raining everyday. He's probably scared too. All because of this landlord and their bullshit stories. They have disreupted our lives and brought so much emotional pain and stress that was not called for. I never did anything wrong. I never let anyone into the building ot into the laundry room, and I have never let anyone through my windows.
These lndlords have no idea what they have done to my family. They have humiliated me and slandered my name through the buildings, cost me tons of money that I did not even have, but I had to pay for a storage unit, and a truck, and have a few people move me last minute. I had a balief come and chase us out of our home. And the nerve of the landlord to laugh at me and make fun when I was moving. Telling me Good luck. And where are your friends now to help you? Nowhere to help you. But you helped them. And now look. What is that to rub in my face? He probably so enjoyed the stress he caused me and my son and our three cats.
Being the cleaner for these landlords was terrible. They both would bug me so much. I would say on average they came 17 days out of the month to harass me about the cleaning. And the funny thing was, I was cleaning. The homelesswould come later and mess. I couldnt keep up with the homeless people. But I tried. There was a lot that the landlords didnt see. That I had cleaned up and tried to keep clean before the landlords came to harass me. But most of the time, the homeless got to the doorways after I had cleaned most of the time. Its like they watched me and then went after, but I did do the cleaning.
I even had found needles stuck inside the vents when I was mopping the floors in the doorways. It was really tough to keep up, since the homeless people would come at all hours of the night.
My landlord had tossed in the security for the both buildings once it started to get really cold outside. The colder it got, the more the homeless came into the doorways and slept.
The homeless have been getting into the buildings way before I even moved in. So, to blame me for them making a mess or letting them into the building was not correct. They have been getting into the laundry room for years. I had to kick out a few people that were homeless from the laundry room a few times.
The landlords had to fix the doors, but it took almost six years to get the doorways fixed. Now since they lock on the outside door, and you need a key to open it to enter the building. The back door still is very easy for these homeless people to get in. A few times, I had heard the door being opened by someone other than a tenant. They would get in still through the back door. I would never let someone that I did not know into the building.
I was getting blamed for these people getting into the building and doing damages to the laundry room door. I have never broken anything in the building ever in the last six years that I have lived at the address #104 11136- 124 St. NW Edmonton Alberta T5M 0J6.
I am asking for compensation for the terrible ways the landlords Gina and Rocky have treated me and my son for the years living at the address mestioned above. The following is the list of compensation that is asked from both of the landords Gina and Rocky.
- The unenjoyable renting from these two landlords; Gina and Rocky has made the last couple of years a living hell. I am requesting. $ 10,000
- They harassed me and yelled at me, made me feel degraded; I am requesting $ 10,000.
- The students who dropped my classes because of these landlords were $ 12,000.
- The stress they caused to myself my son and our pets. $ 5000
- The emotional stress pain and humiliation of $ 5000
- The amount of money that is owed for cleaning; in Alberta is $15.50 per hour. I was cleaning both buildings every second day, and only receiving $300 per month for both buildings. I would clean for 2.5 hours per building. And together that would be 5 hours every 2 days and weekends more. 15.50 x 5hrs = $77.50 x 4 days = $310 per week. For 15 months. $ 18,600.00 -$4500.00= $14,100.00 that is owed for cleaning both buildings.
- Move-outs are average $300. my son and I have done 3. $900 -$150= $750.00 owed for the move-outs. Cleaning, painting. Windows. Cockroach infestations.
- My pet that is missing $2500
- My furniture is $ 5000
- My kitchenware $ 4000
- Our bedroom sets $ 5000
- Clothing $4000
- Electronics $4500
- BMX Haro $2500
- Personal Items $8000
